KIDZY PRIVACY POLICY

EFFECTIVE ON SEPTEMBER 1, 2016

Kidzy, LLC (“we”, “us”, or “Kidzy”) respects the privacy of our users.  This Kidzy, LLC Privacy Policy (“Privacy Policy”) describes our practices with respect to information we collect from or about our users in connection with the website www.kidzy.co and its subdomains (the “Site” or “Sites”), any downloadable application we make available to you (the “App”), our social media pages and email communications that link to this Privacy Policy, and any other software or services we make available to you (together, the “Services”).

This Privacy Policy explains how Kidzy collects, uses, and discloses Personal Information and Other Information (each as defined below) in connection with the Services, and your rights in relation to that information.  By using our Services and/or the features made available to you through the Services, you are agreeing to the terms of this Privacy Policy and consenting to the collection, use, and sharing of information in a manner consistent with this Privacy Policy.

The Personal Information and Other Information that we collect about you is controlled by Kidzy, LLC which is headquartered in the United States in New York, New York.  As described in the section below entitled “Information for Users from Outside the United States,” the information that we collect through or in connection with the Services may be transferred to and processed in the United States.

WHAT PERSONAL INFORMATION AND OTHER INFORMATION WE COLLECT ABOUT YOU

We collect both Personal Information and Other Information about our users in connection with the Services.  For purposes of this Privacy Policy, “Personal Information” is information relating to an identified or identifiable person, such as a name, email address, username, or profile picture, that we collect about our users.  “Other Information” is any additional information that we collect about our users that is not Personal Information.  When we combine Other Information with Personal Information, we treat all of the combined information as Personal Information.

We may collect and process the following information about you:

Personal Information and Other Information you provide to us.  You can visit the Site without submitting any Personal Information.  However, if you use certain features available via our Services, you will be required to provide Personal Information.  Such information could include, for example, your name, email address, telephone number, postal address, company, job title, and/or industry.  You also may provide us with Personal Information and Other Information directly through the Services (e.g., when you edit your account profile; post Content; respond to surveys or requests to rate the Services; or when you correspond with us).

We may combine Personal Information collected through the Services with Other Information that we collect about you in other contexts—such as our communications with you via email or phone, or your customer service records.  We will treat such combined information as Personal Information and protect it in accordance with this Privacy Policy.

Log data.  When you use the Services, we automatically receive and record certain information from your computer, mobile phone, or other device, and your browser.  This may include data such as your IP address, the pages you visit or features you use within the Services, the date and time of your activities on the Services, the URLs from the websites you visit before and after navigating to the Services, your software and hardware attributes (including operating system type and version, App version, device type, and device identifiers), your browser type and version, and your general geographic location (e.g., your city, state, or metropolitan region).  To obtain such information, we may use web logs or applications that recognize your device and gather information about its online activity.

Cookies.  We also use cookies on our Services.  Cookies are small files that are stored on your computer by your web browser.  A cookie allows the Sites to recognize whether you have visited before and may store user preferences and other information.  For example, cookies can be used to collect information about your use of the Sites during your current session and over time (including the pages you view and the files you download), your computer’s operating system and browser type, your Internet service provider, your domain name and IP address, your general geographic location, the website that you visited before the Sites, and the link you used to leave the Sites.  If you are concerned about having cookies on your computer, you can set your browser to refuse all cookies or to indicate when a cookie is being set, allowing you to decide whether to accept it.  You can also delete cookies from your computer.  However, if you choose to block or delete cookies, certain features of the Sites may not operate correctly.

Web beacons.  The Sites or the emails that you receive from Kidzy may use an application known as a “web beacon” (also known as a “clear gif” or “pixel tag”).  A web beacon is an electronic file that usually consists of a single-pixel image.  It can be embedded in a web page or in an email to transmit information, which could include Personal Information.  For example, it allows an email sender to determine whether a user has opened a particular email.

Third-party data collection.  We also may partner with certain third parties to collect, analyze, and use some of the Personal Information and Other Information described in this section.  For example, we may allow third parties to set cookies or use web beacons on our Services or in email communications from us, or we may allow third parties to use an application software development kit (SDK) or server-to-server connection to collect information.  An SDK is a section of code that we embed in our App to allow third parties to collect information about how users interact with the App, and a server-to-server connection enables us to exchange data with third parties when an SDK integration is not feasible or practical.  The information collected by third parties using these technologies may be used for a variety of purposes, including analytics, as discussed below (see the section entitled “How We Share Personal Information and Other Information with Third Parties”).

HOW WE USE THE PERSONAL INFORMATION AND OTHER INFORMATION WE COLLECT

Kidzy uses the information that we collect for a variety of purposes.  For example, if we have Personal Information about you, we may use it:

To provide our Services to you and improve the Services.  We use the Personal Information that we collect about you to provide the Services to you, including:  to fulfill the terms of any agreement you have with us; to fulfill your requests for our services or otherwise complete a transaction that you initiate; and to improve your user experience and the quality of our Services.

To contact you and send promotional communications.  If we have Personal Information about you, we also may use it to communicate with you, for example, to deliver relevant messages or information to you via notifications on your mobile device, to respond to your questions or requests concerning the Services, to send you information about our Services and other topics that are likely to be of interest to you, including newsletters, updates, or other communications, or to deliver confirmations, account information, notifications, or similar operational communications.  If you opt in to receive marketing emails from us, we also may use the Personal Information and Other Information that we collect to send you promotional communications, including emails or postal mail about the products and services offered by Kidzy or our partners.  Although we hope you will find our promotional emails of interest, you may opt out of receiving them by sending an email to info@kidzy.co with “optout” in the subject line.  Promotional emails will also have instructions for opting out of that type of communication in the future.

To provide social networking or other sharing features.  We may use Personal Information to enable social networking features, to allow you to comment or post on the Services, to find and connect with your friends (when instructed by you), and in connection with other sharing features.

For legal purposes.  We may use and share Personal Information for legal purposes, including as described below in the section entitled “How We Share Personal Information and Other Information with Third Parties.”

If we have Other Information about you, we may use it:

To manage our business.  We use Other Information to help us efficiently operate the Services, to count and recognize visitors to the Services, to enable certain features on the Services, and for other purposes related to managing our business.

For analytics and to improve the Services.  We use Other Information to analyze how visitors use the Services and their features, to improve the Services and enhance users’ experiences, to create new products and services, and to enable additional analytics and research concerning the Services.

For other purposes.  As permitted by applicable law, we may use Other Information for additional purposes in connection with the Services, including any purpose for which we may use Personal Information, as described above.

HOW WE SHARE PERSONAL INFORMATION AND OTHER INFORMATION WITH THIRD PARTIES

We share your Personal Information and Other Information with other parties for a variety of purposes, as described below.

Third-party service providers.  We use third-party service providers to help us manage and improve the Services.  These service providers may collect and/or use your Personal Information or Other Information to assist us in achieving the purposes discussed above in the section entitled “How We Use the Personal Information and Other Information that We Collect.”  For example, we may use third parties to perform data storage and processing services for us and to help us deliver our email communications to our users.

We may share your Personal Information or Other Information with other third parties when necessary to fulfill your requests for services; to complete a transaction that you initiate; to meet the terms of any agreement that you have with us or our partners; or to manage our business.

Your direct sharing of information with other users of the Services.  The Services enable you to share Personal Information and Other Information with other users of the Services.  For example, if you post Content through the Service or respond to surveys or requests to rate the Services, then your recommendations or comments may be seen by other users of the Services.  Please ensure when using these features that you do not submit any Personal or Other Information that you do not want to be seen, collected, or used by other users.

Your direct sharing of Personal Information through third party websites and services.  Our Services may enable you to directly share Personal Information with websites or online services operated by third parties.  For example, our Services may contain links to third party websites that incorporate comment and social media features.  Our Services also contain a Facebook “like” button, a Twitter “follow” button, and links to Instagram, LinkedIn and YouTube.  If you choose to use these features, you may disclose your Personal Information not just to those third-party websites and services, but also to their users and the public more generally.  Because these third party websites and services are not operated by us, we are not responsible for the content or practices of those websites or services.  The collection, use and disclosure of your Personal Information and Other Information will be subject to the privacy policies of the third party websites or services, and not this Privacy Policy.

Third party plugins.  Our Services integrate certain third party plug-ins (such as a Facebook “like” button).  Even if you do not click on these plug-ins, they may collect information about you, such as your IP address and the pages that you view.  They also may set and/or access a cookie.  These plugins are governed by the privacy policy of the company providing them.

Analytics.  We partner with certain third parties to collect the Other Information discussed above and to engage in analysis, auditing, research, and reporting.  These third parties may collect information through cookies, web logs, web beacons, or SDK and server-to-server technologies.  They may set and access cookies on your computer or other device and may collect information about your online activities across different websites or services over time, including on websites and mobile applications that are not owned or operated by Kidzy.

In particular, the Services use Google Analytics to help collect and analyze certain information on the Site and the App for the purposes discussed above.  You may opt out of the use of cookies in web browsers by Google Analytics by clicking here.  Like many other online services, the Services do not respond to “do not track” browser signals with respect to such sharing with third parties.

Our Services also enable third-party tracking mechanisms to collect your Other Information for use in online behavioral advertising.  For example, third parties may use the fact that you visited the Site to target online ads for Kidzy services to you on non-Kidzy websites.  Please note that the use of online tracking mechanisms by third parties is subject to those third parties’ own privacy policies, and not this Privacy Policy.

Legal purposes.  We also may use or share your Personal Information or Other Information with third parties when we believe, in our sole discretion, that doing so is necessary:

  • to comply with applicable law or a court order, subpoena, or other legal process;
  • to investigate, prevent, or take action regarding illegal activities, suspected fraud, violations of our terms and conditions, or situations involving threats to our property or the property or physical safety of any person or third party;
  • to establish, protect, or exercise our legal rights or defend against legal claims; or
  • to facilitate the financing, securitization, insuring, merger, sale, assignment, bankruptcy, or other disposal of all or part of our business or assets.

Anonymized or aggregated information.  From time to time, we may also share anonymized and aggregated information about users of the Services, such as by publishing a report on trends in the usage of the Services.

DATA RETENTION AND SECURITY

We use commercially reasonable physical, electronic, and procedural safeguards to protect your Personal Information against loss or unauthorized access, use, modification, or deletion.  We encrypt Personal Information when we transfer it to third parties over the Internet.  However, no security program is foolproof, and thus we cannot guarantee the absolute security of your Personal Information or Other Information.

Kidzy may retain Personal Information as long as necessary to provide the services to you and to fulfill the purposes described in this Privacy Policy.  If you would like Kidzy to delete the Personal Information associated with your account, please follow the instructions in the “Reviewing, Updating, and Deleting Your Personal Information” section below.

REVIEWING, UPDATING, AND DELETING YOUR PERSONAL INFORMATION

If you would like us to permanently delete your account, and the Personal Information associated with your account, you may send us a request via email to info@kidzy.co.  We will attempt to delete your Personal Information in a prompt manner, but please note that residual copies of such information may remain on backup servers or tapes until they expire, and Kidzy may be required by law to retain copies of such information.

You may have additional rights under applicable law to access, amend, and/or request deletion of certain information.  To inquire about such rights, please send us an email at info@kidzy.co.  For your protection, we may only implement requests with respect to the information associated with the particular email address you use to send us your request, and we may need to verify your identity before implementing your request.  We will attempt to comply with any reasonable requests for accessing, amending, or deleting your information.

INFORMATION FOR USERS FROM OUTSIDE THE UNITED STATES

The Personal Information and Other Information that we collect through or in connection with the Services may be transferred to and processed in the United States for the purposes described above.  Kidzy also may subcontract the processing of your data to, or otherwise share your data with, affiliates or third parties in the United States or countries other than your country of residence.  The data-protection laws in these countries may be different from, and less stringent than, those in your country of residence.  By using the Services or by providing any Personal Information or Other Information to us, you expressly consent to such transfer and processing.

CHILDREN'S PRIVACY

The Services are not directed to children under the age of 13, and Kidzy will never knowingly collect Personal Information or Other Information from anyone it knows is under the age of 13.  Our Services are available only to, and may only be used by, individuals who are 18 years and older and who can form legally binding contracts under applicable law.  Children under the age of 18 may only use our Services with and under the supervision of a parent.  In such a case, the parent is responsible for any and all activities of such minor.  If you are a parent or guardian and you discover that your child has created an unauthorized account on our Services, please contact us at info@kidzy.co and we will remove the account.

THIRD-PARTY LINKS, WEBSITES, AND APPS

The Services may contain links to and from the websites or apps of other third parties.  If you follow a link to any of these websites or apps, please note that these websites and apps, and any services that may be accessible through them, have their own privacy policies.  We are not responsible for the privacy practices of other websites or apps.  We encourage our users to be aware when they leave the Services and to read the privacy policies applicable to such third-party websites and apps.  This Privacy Policy applies solely to information collected in connection with the Services.

SENSITIVE INFORMATION

We ask that you not send us, and you not disclose, any sensitive Personal Information (e.g., social security numbers, financial account information, information related to racial or ethnic origin, political opinions, religion or other beliefs, health, criminal background, or trade union membership) on or through the Services or otherwise to us.

CHANGES TO THIS PRIVACY POLICY

Technology and the Internet are rapidly changing.  We therefore are likely to make changes to the Services in the future and as a consequence will need to revise this Privacy Policy to reflect those changes.  We will post all such changes to the Privacy Policy on the Site, so you should review those pages periodically.  If we make a material change to the Privacy Policy, you will be provided with appropriate notice.  If we maintain your email address, we also may email you a copy of the revised Privacy Policy at your most recently provided email address.  It is therefore important that you update your email address if it changes.
